Welcome to K Photography Malta. These Terms & Conditions outline the rules and agreements that apply when booking or using our photography and videography services through kphotographymalta.com.

1. Acceptance of Terms

By engaging our services, submitting a booking, or using our website, you agree to these Terms & Conditions. Please read them carefully before making any commitment.

2. Scope of Services

K Photography Malta provides professional photography and related services, including:

  • Wedding, pre-wedding, and post-wedding photography
  • Corporate branding and lifestyle photography
  • Holy Communion, baptism, and family portrait sessions
  • Event coverage and videography

All services are subject to availability and confirmed only upon receipt of a signed agreement and/or booking fee.

3. Bookings & Deposits

  • A booking is confirmed only after a deposit (or retainer) has been received.
  • Deposits are non-refundable but deductible from the total balance.
  • The remaining balance must be paid before or on the day of the session/event unless otherwise agreed in writing.
  • Failure to pay the balance may result in withholding of images or cancellation of service.

4. Cancellations & Postponements

Should a booking be cancelled, deposits are non-refundable. If rescheduled, the payment may be transferred to a new date, subject to availability. In the unlikely event that K Photography Malta must cancel, all monies paid will be refunded in full, and reasonable efforts will be made to find an alternative photographer.

5. Client Obligations

  • Clients are responsible for obtaining all necessary permissions for photography at venues or locations.
  • Clients agree to cooperate, be punctual, and follow guidance during sessions to ensure the best possible results.
  • Any additional time or requests outside the agreed duration may incur extra charges.

6. Image Rights & Usage

  • K Photography Malta retains copyright of all images and videos captured during a session.
  • Clients receive personal usage rights for sharing, printing, and non-commercial use.
  • Commercial or promotional use by the client requires prior written permission and may be subject to a licensing fee.
  • Images may be used by K Photography Malta for portfolio, social media, and marketing purposes unless the client opts out in writing.

7. Editing & Delivery

  • All delivered images are professionally edited and colour-corrected according to K Photography’s artistic style.
  • Delivery timelines vary by service type:
    • Weddings: 8–12 weeks
    • Corporate / Events: 1–2 weeks
    • Communions / Baptisms: 2 weeks
  • RAW (unedited) files are not provided.
  • Delivery is made digitally via a secure online gallery or link.

8. Limitation of Liability

While all care is taken during photography and storage, K Photography Malta shall not be held liable for any loss, damage, or delay caused by events beyond our control, including but not limited to equipment failure, illness, weather, or unforeseen circumstances.

Liability is limited to the total amount paid for the service.

9. Privacy & Data Protection

Your personal data is collected only for communication, contract fulfilment, and legal obligations. We comply with the General Data Protection Regulation (EU 2016/679) and our Privacy Policy.

10. Governing Law

These Terms & Conditions are governed by the laws of Malta. Any disputes arising will be subject to the exclusive jurisdiction of the Maltese courts.
